EU General Data Protection Regulation (“GDPR”)

If you have an interest in Tirlán Limited or engage in trading activity with Tirlán, the following Data Protection Notice will govern how we use and disclose your personal data.

 

DATA PROTECTION NOTICE

For the purposes of this notice, “Tirlán” or “we” means Tirlán Limited and its subsidiaries.

Tirlán is committed to ensuring that your rights under data privacy laws are protected and personal information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect and process in accordance with the EU General Data Protection Regulation General Data Protection Regulation (REGULATION (EU) 2016/679).

Tirlán has established internal processes to meet its obligations for responding to data subject requests and complaints.

Within the European Union, data is collected and processed under the legal basis of Legitimate Interest in relation to the use of personal data outlined within this notice.

 

DATA WE COLLECT

During the time that you have an interest in Tirlán Co-operative Society Limited (‘The Society’) or engage in trading activity with Tirlán, we will collect the following categories of personal data:

  • Identity Data including first name, middle name(s), surname;
  • Identity Verification Data including: date of birth and, in certain cases, certified copies of proof of identity such as passport or utility bills;
  • Contact Details including: address, telephone number, e-mail address;
  • Bank account details to facilitate payments to you by Tirlán;
  • Details of accounts through which the member or customer may trade with Tirlán.

 

Special Considerations:

  • In respect of deceased shareholders in the Society: date of death, names of next of kin and legal personal representatives, details of Solicitors representing the deceased shareholder;
  • Occupation [Witnesses to legal agreements];
  • Employee number [Revolving Share Plan applications];
  • Personal relationship to specified third parties [disclosure of ownership of companies / partnerships];
  • Herd Number [Milk Suppliers].

 

Revenue Arrangements:

  • Members may elect to provide PPS numbers to the Society to facilitate the processing of share transfers by the Society on behalf of the member.

WHAT WE DO WITH THE INFORMATION WE COLLECT

We use this information to provide you with a comprehensive service as a Society member, supplier and / or individual trading with Tirlán and to ensure that our services are managed in the most efficient manner for you, and in particular for the following reasons:

  • For internal record keeping purposes to support purchases and the delivery of services outlined;
  • To carry out our obligations arising as a result of your interest in the Society including:
    • Milk Supplier agreements;
    • Grain Supplier agreements;
    • Customer sales and account management;
    • Shareholder / Member data management and maintenance;
  • To notify you about changes and updates to our products or services or other relevant information;
  • We may contact you by electronic means (e-mail or SMS) with information which will be of interest to you as a member of the Society, supplier or individual trading with the Companies;
  • For subscribers to our on-line services, we may use the information provided through our on-line channels to customise our website according to your interests

Tirlán will retain your data for the duration required to fulfil the purposes outlined in this policy, meet any legal and regulatory requirements and shareholder / member maintenance. We also retain your data to maintain a trading history for reporting and member benefits for a period not less than 7 years beyond your association with Tirlán.

 

CHANGE OF PROCESSING PURPOSES

We will only use your personal data for the purposes for which we collected it, a legal or regulatory requirement or legitimate interest to use it for another reason that is compatible with the original purpose.

Where we need to use your personal data for unrelated purposes, we will notify you and explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

 

SHARING AND DISCLOSURE OF DATA

Except as set out below, we do not disclose your personal data to any third party. We may also disclose your personal data with statutory bodies where we have a legal obligation to do so.

Bodies we share your information with in order to fulfil our obligations to you:

  • Computershare: We may from time to time disclose certain information to enable shares in Glanbia plc to be issued to you in exchange for a portion of your Society shares where Society members approve a “spin out” of shares in Glanbia plc in exchange for Society shares;
  • Revenue Commissioners: Subject to your specific approval and the provision of your PPS details, we may disclose details of your transactions in Society shares in order to pay the relevant stamp duties on your behalf;
  • Persona: We may from time to time disclose relevant personal data with our contracted agents, Persona, to enable the completion of mailouts to you;
  • Regulatory / government agencies involved in the governance of dairy, agriculture and consumer food chain services;
  • External testing laboratories directly sub-contracted by Tirlán, including Teagasc, as an extension of in-house laboratory services and to fulfil legal obligations.

 

CONTROLLING YOUR PERSONAL INFORMATION

You may choose to restrict the collection or use of your personal information in the following ways:

  • You have the right to ask us not to process your personal information for marketing purposes and whenever you are asked to fill in a form on the website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes;
  • Where no longer required for the stated purpose of collection or associated legal requirements, GDPR also provides you with a right of erasure with respect to the data processed by Tirlán;

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

You may request details of personal information that we hold about you under the General Data Protection Regulation (REGULATION (EU) 2016/679). There is no charge applied to data access requests where reasonable and not excessive in line with Article 15 of the legislation.
